Protecting Intellectual Property In China: Theory And Practice

Akin Gump Strauss Hauer & Feld LLP has scheduled a seminar titled Protecting Intellectual Property in China for Tuesday, April 25.

Yitai Hu is the partner in charge of the Silicon Valley and Taipei offices of Akin Gump Strauss Hauer & Feld LLP. Drawing on his experience, Mr. Hu will discuss not only the acquisition and enforcement of all types of IP rights, but also the realities of enforcing and defending against IP claims. He will apply these issues to real-world business situations. Mr. Hu will examine the current Chinese IP laws, highlighting the similarities and differences between the Chinese and U.S. statutes. He will then discuss practical aspects of enforcing those rights, including a comparison of the relevant administrative agencies, courts and procedures available. His focus will be on strategies to avoid the need for enforcement actions and, if necessary, the factors determining which procedure is appropriate for any given dispute.

Mr. Hu will discuss the likely sources of claims brought against foreign companies operating in China (the sources may surprise you!) and how to defend against such claims.

The topics he will discuss include -

obtaining enforceable patents and trademarks and copyrights

registrations, including problems in transliteration;

civil, administrative or criminal: match the venue to the desired outcome; and

likely sources of IP claims brought by others and strategies to avoid or defend against such claims.
