Meet-The-Author: Is It A Trademark License Or A Franchise Agreement?



You entered a trademark license, but has the licensor retained so much control that a franchise relationship has been created? Or, you entered a franchise agreement, but do the provisions adequately protect the brand?

These and other questions about the intersection of trademark and franchise law will be addressed at a Meet-the-Author seminar on March 25, sponsored by the Intellectual Property and Technology Industries Committees of the New Jersey Corporate Counsel Association.

Mary Hildebrand, who heads the Intellectual Property-Corporate Practice Area of Goodwin Procter LLP, will provide an overview of how franchises are created, maintained and terminated. She will focus on some of the unique provisions of New Jersey's franchise laws, which should be taken into consideration when drafting the choice of law provisions in license, franchise, distribution and other agreements.
